ข้อตกลงทางด้านลิขสิทธิ์

1. ) สิทธิ์ในงานออริจินอล

• งานดนตรีกรรม ไม่ว่าจะเป็นดนตรี คำร้อง ทำนอง ไฟล์เสียง โน๊ตเพลง หรือสื่ออื่น ๆ เช่นสิ่งบันทึกเสียง ไม่ว่าจะอยู่ในรูปดิจิตอลหรือสื่อที่จับต้องได้ ซึ่งจากนี้จะเรียกว่า "งานออริจินอล" ที่ถูกสร้างขึ้นโดย CFableMusic และศิลปินผู้ร่วมสร้างสรรค์ทั้งหมด ถูกคุ้มครองโดยกฏหมายลิขสิทธิ์ที่เกี่ยวข้อง ทั้งกฏหมายของประเทศไทยและข้อตกลงทางด้านลิขสิทธิ์นานาชาติ
  • The “Original Works” are considered intellectual property of CFableMusic and respective co-creator.
• 1.2) All form of “Original Works” may not be reproduced, modified, distributed, reuploaded or otherwise use without the express written permission or license from CFableMusic. Implication of ownership or otherwise which may mislead the public that the an identity whether a person or a group is the owner and/or creator of “Original Works” is also prohibited.
  • Except for:
    • 1.2.1) “Original Works” which explicitly stated that the work is licensed under Creative Commons (CC) which those who intended to use the “Original Works” shall abide by the condition of the CC license.
    • 1.2.2) “Original Works” which explicitly stated that the work is licensed by under specific limited free-use condition set by CFableMusic which those who intended to use the “Original Works” shall abide by the terms and condition on such specific work.
    • 1.2.3) The use(s) which fits under “fair-use” with respect to Copyright Act (No.5), B.E. 2565 (2022), Thailand or its proceeding revision. For the clarity of “fair-use”, a simplification of the use cases law are included as below, the user is still advised to read and understand the full legal comprehension of the “fair-use”:
      • Non-commercial educational uses (Section 32(1), Section 32(6), Section 32(7) and Section 32(8)) is permitted
      • Personal enjoyment and uses (Section 32(2))
      • Comment / review / criticize the work with full acknowledgement to copyright owner (Section 32(3))
      • News reporting through mass media with full acknowledgement to copyright owner (Section 32(4))
      • Judicial, legal administrative proceedings by authorized official including its reports (Section 32(5)
• 1.3) All form of “Original works” are prohibited from being use in illegal or immoral activities including those which would otherwise be considered defamatory. CFableMusic reserves the right to restrict the use of such work at its sole discretion.
• 1.4) Any unauthorized monetization, commercial transaction, activities and/or otherwise unauthorized use of “Original Works” will result in either one or more activities, to the extent permissible by relevant law below:
  • Enforcement of payment at a specific rate of license cost which is deem appropriate, this cost is retroactive, persistent throughout the period of unauthorized usage.
  • Enforcement of payment at a fair amount, derived of the profit that the unauthorized user gained
  • Legal action against the violation according to relevant copyright laws and DMCA.

2. ) Commissioned Musical Work Ownership:

• 2.1) Unless specified in other agreement, contracts or condition of hire, all musical compositions, sound recordings, and/or other form media which is created or provided by CFableMusic (both digital and physical, herein after “Commissioned Works”). In general:
  • The “Commission Works” are still considered intellectual property of CFableMusic and respective co-creator. All rights and title to the “Commission Works” are reserved.
  • The hirer (also known as “Commissioner”) is granted a non-exclusive, perpetual license to use the “Commissioned Works” for the agreed purpose, including commercial uses.
